To your first question, yes, an involuntary manslaughter charge, if requested by the victim, should be added. The rape charge would probably hold a higher penalty, though.
To your 2nd question, it seems that both parties are supporting Israel's use of "collective punishment" in violation of the Geneva Conventions.
