i never actually listened to Dani California that closely before but now that you mention it i can so hear Mary Jane's Last Dance....after you get passed the opening of the song and when Petty starts to sing....is soo Dani California.....
and yes the new cd is great.

You r totally right on all counts. It is a rip-off and Tom Petty is great. But you can't underestimate his bandmate Mike Campbell's contributions. He would put out a great cd just by himself. Tom would never bring a lawsuit against anyone because a)no need 4 money and b) he has been thru so much during his career, and he's so cool he understands all the sh** he would have 2 go thru.

Everything musical is built upon what others have done previously.
This particular example is fairly close to plagiarism, but I think it is big of Petty to take the higher road.
Why waste time, money and effort on suing someone when you can constructively channel your energies into creating something new for yourself?

Here's the thing though, Bob Rock produced both Dani California and Last Dance with Mary Jane. Shouldn't he have said something to the Peppers, like "hey that sounds a lot like Last Dance". I really blame him. There are only so many notes and so many combinations. You are going to wind up with songs that sound similar.

The songs' lyrics and chord progressions are really similar between Mary Jane's Last Dance and Dani California. I like both of the songs, though.

Any chance that RHCP actually procured the rights to the song before reproducing parts of it? Perhaps I missed something, but I haven't seen any news that RHCP ripped this off of Tom Petty without permission. If I did miss it, links would be appreciated.

first off they didnt rip them off, I love both of there music, there is only three cords they play that are the same, plus they had the same manager produce the albums so maybe he had something to do with the so called ripping of the song.....thats old news anyway
