1. go ahead and record his calls. hopefully he'll just be stupid enough to leave his threats on your answering machine, that's certainly not illegal on your part. as for recording calls where you talk to him, you can always find out later if it's illegal to record a call in your area, and if so, you just erase it. however usually if it is illegal, it's to prevent misuse of the conversation, not for protecting yourself. it's NOT illegal as long as you tell him you're recording the call. :)
2. write down everything he says when he calls as well, it could come in handy later for quoting into court documents, especially if you can't use the recordings.
3. keep a record of the dates and times of his inappropriate calls, what he said, and any witnesses, then after about 3 such calls, call the police to press charges of phone harrassment.
4. get a restraining order immediately. guys like him don't care about you threatening to do anything. getting the order or just threatening has the same result: it pisses them off and results in them continuing to act like asses, but if you only threaten, then he knows you're not gonna do anything. at least if you get it, you and the police and courts have legal recourse if he keeps up his crap.
5. make sure that your lawyer and/or the judge in divorce court get a copy of your restraining order.

If he threatens you, have your attorney request a temporary restraining order. If he is threatening someone else, they will have to take care of themselves (restraining order, police, etc).

Your divorce papers may or may not have a temporary hearing set up (depends on the situation). If it does, then you need to have your attorney request the restraining order. There can be language that will prohibit your husband from calling and harrassing you. If there are children involved, he would only be able to call to check on the children/speak to the children.

I'd avoid the restraining order...for now. Pick up a copy of "The Gift of Fear" by Gavin de Becker. It is an excellent book about how to predict if people will be violent in personal situations. For now I'd recommend that you get a male friend to re-record your outgoing message. I'd avoid talking with your husband if he is angry. You may want to call the phone company and ask them if they can recommend any solutions (such as recording conversations, caller ID, etc.).

The man who wrote it used to work for the Supreme Court by evaluating threatening letters written to them. He also provides private security for Movie and Rock stars. Excellent, excellent book. Highly recommended.

Its called Intimidating a witness. It's illegal. Call your lawyer and get some protection, like a restraining order until you are done with court. If you need a continuance after that, get it. I'd get out of Dodge as soon as possible tho.

You could get a restraining order. Hopefully this would prevent him from harassing you and keep him away from this "someone". If he's the type that would only be agitated by this and the order wouldn't stop him, you'd still be better off having it. At least you can have some sort of proof of his actions.

What do you do well first pat your self on the back for a good decision then next time he calls and threatens you, you can:
tell him "well that's going to change my mind"
tell him "I'm getting a restraining order and if you call I will tape it and send you to jail for herrassment
tell him "I know your hurt now go cry on someone elses shoulder"
tell him "It's over we don't want the sequal"
tell him "If you keep crying about it I will call a wambulance"
tell him "Oh your so romantic and hang up"
tell him "I'm a lady not a baby so don't bully me"
tell him (and this is my favorite) nothing and just record his crap and have him arrested get a restraining order change your number and get a real man, you deserve better and you know it!

File a harassment complaint with the police. If he continues to bother you it will be on file, and you can then get a restraining order. Hopefully he was just blowing off steam, and will calm down. Make a formal complaint just incase better safe than sorry.

Actually as difficult as it is, you say nothing. Simply say, I respect what you are saying, but it is 2am in the morning, and yelling on the phone will not change things. Thank you for calling. Don't fall for his empty threats. If he wants to whip someones butt, that is his business.

You can file for a restraining order. In many cities there is an advocate available right in the clerk of courts' office who can help you fill out the forms.

hang up. If he calls again call the police and file harassment charges. If that doesn't work get a restraining order. He won't bother you again. You could always change your phone number
