Well, legally, this law will be overruled as soon as the case is brought to court. The district court will overrule the law. Appellate courts probably won't even hear the case. The Supreme Court, though extremely conservative right now, would never overturn Roe because there is too much precedent based on it, including topics well outside of abortion (ie- personal privacy).

I have no idea what they are arguing nor did your question give me a clue. All Roe v. Wade did was make it legal to perform abortions where it was clearly in the mother's best mental and physical well being to do so and only with the supervision of an attending physician in a hospital. In truth the decision was in response to two cases that came before the court at the same time, so they were merged into Roe v. Wade. The questions were essentually was it fair to make a person have to go from one state to another to get an abortion, and should there be a uniformed standard for when an abortion should be performed. Obviously the answers were, no to the first part and get a doctor to decide if you need an abortion or not in the second part. I am simplifying it but the verdict is long and you can pull it up on the web if you want to. At any rate, it mostly legal fiction. It is poorly written and vague throughout. The problem is it has been used as precedent in other cases. If you strike it down you will have to strike down other laws as weel, laws dealing with privacy. So don't expect Roe V. Wade to be emolished of the the Law in South Dakota to require that Roe v. Wade be demolished. What you may see here is another piece of legal fiction further stipulating that common standard for all abortions. It is long overdue given the subject matter and the fact that most abortions are not performed in hospitals, some are not even surgical, some can be purchased over the internet, and some of the people dispensing these abortions are not doctors and have never even met the women involved.

The thing that I believe the so called "pro-life" movement doesn't understand is that no one is pro-death. Pro choice proponents simply want it to be kept safe, legal, and rare. No one wants to see life end, but the real world isn't all black and white.

No law is going to stop abortion. All the law can do is make abortions all lot more risky since they will not be performed by licensed doctors. All it takes is a determined pregnant woman with a wire hanger to perform an abortion.

All these pro-life types either need to put up or shut up. If they don't want to see fetuses aborted then they need to adopt the unwanted infants. I'd like to see how many of them will be lining up to adopt a two pound crack baby on life support.

You picked a nice thorny one!

While I and most pro-life people would look to the day when the law would guarantee unborn citizens the right to life, I know that legislation won't end the problem. This is one of those issues that can only be debated and argued for in the hearts of men, not in any court or on any assembly floor. To pass a law of which the individual citizen cannot see the virtue would be fruitless. A great change in our social attitudes is necessary to protect the unborn, and no law has the power to do anything without public support or tyranny...I'd rather the public freely and of its own volition support such a law.

I am firmly Pro Choice. Mostly, because I was around before Roe vs. Wade and I remember what it was like. Women died. Lots of women died because they were so desperate to end their pregnancy that they were willing to try anything. A lot of things have changed since then, but that has not changed my stance. I like to think that the difference between someone who is pro choice and someone who is not is I support your right to choose life or abortion. Everyone must decide what is best for them. I am not a god, therefore I cannot know what is right for every woman on the face of this earth.

I don't believe in abortion. Women are given a choice on whether or not to bring life into this world and I truly do not see how a woman can choose to abort a life that she has helped create. Life begins from the moment of conception - that is how a baby grows, gets nourished, moves, etc. in the womb.

abortion should be legal or a lot of women are going to die. The pro-life people bomb the clinics and kill the nurses and doctors, yet they say they are pro-life. How's that? Especially men, they don't get pregnant, don't go thru a horrible pain of giving birth, don't have to worry about their health and the health and well being of the baby in the difficult circumstances, yet they got the nerve to say that women should not have abortions at all circumstances? That's absurd!

Abortion is not about killing or murder, it is about who your God is. Every cell in the human body is alive. But when these cells are killed we are not murdering or killing, we are simply doing what is required to make our lives better. And abortion is the same in the eyes of God. God invented abortion in the form of miscarriage. Therefore to say that abortion is murder is to say that God is a murderer. It you clip your nails, remove a cancerous toe, or remove a fetus, you have not murdered.

People are defined by the God they choose to follow. I follow the God of the bible and his Pro Choice views. My God invented abortion because he knows that sometimes it is not right for a child to be born. MY God knows when it is wrong and right. MY God does not kill babies or fetuses. MY God takes the soul of the fetus and protects it from harm. MY God does not fear the actions of men or the effect of their actions. MY God has the power to correct mistakes made by men.
The pro life god is a weak god. Their god allows the murder of innocent children and the killing of doctors and the bombing of hospitals. Such a god should not be followed. Do you choose my all powerful, all loving God or do you choose the hate filled murdering god of the pro life movement? Who will you follow? Who will you believe?

I don`t care for abortions but I also don`t want dumpster babies to come back. I don`t see why a abortion is worse then a babies last breath of hot trash in some dumpster somewhere.
