You should have called your cell phone company the minute you found out that it was missing. They may hold you responsible for the charges. Call them and explain the situation.
Call the police to file a report, and name her as the culprit. She may hand the phone over with no questions asked.
You can also sue her for the money of the bill in small claims court, go to your local courthouse to fine out how.

She either will return the phone to avoid an arrest (maybe) or she will be obligated to pay you back as you will have a police report to prove your case in court (municipal). Tell her that you'll get your phone back or you'll get the money, one way or another.
Definitely call the police though to report it missing and ask the friends to act as witnesses. This may scare her into giving it back. Also, contact your service provider to report it stolen AFTER you file a police report. The service provider will probably offer you a replacement phone until you either get yours back or buy another one.

I would call your cellphone provider to have her cut off, the ESN (electronic serial number) is on the cell phone under the battery. You probably still have the box and the receipt and that number is on there. Hopefully she is not still using your service, but definitely make sure you are not still paying for it first. Then I would call the police and report it stolen and show your paperwork that it was your phone, as soon as they check the serial number they will know it was your phone and it will be returned to you.

Well if you aren't gonna smack her up and take the phone back at least get the service switched off of that phone. Seems to me that you could bring some kind of charges against her and force her to pay the 300 hundred dollars.

Get over it, so you lost some money, it's not the end of the world. If you keep worrying about it, and fretting over it, all you will end up doing is making yourself sick.
We all have things stolen from us, at one time or another, that's life. So do what you did, when you didn't beat her up. Just forget about it, curse her, and move on.
You will get another cell phone, and life will go on as usual.

first of all, the moment you realized it was gone, you should have called the phone company to shut it off so she couldnt have made any calls on it, now i dont know what your tel. companys policy is on stolen phones and the bill that was racked up but since so much time has passed they may not believe you when you tell them that. you are probably gonna have to pay that stupid bill. but, maybe you could get those two people that saw her write out a statement and have it notarized and take it to the phone company, otherwise you are gonna have to sue her for that bill. worse, it you are underage, your parents stand responsible for that bill and it's up to them to get the money out of that thief.

Next time report the phone missing asap and shut down the number.
You can take her to small claims court. Or you can report er to the cops.

next time dont spend soo much on a phone. they drop in price like after a few months anyways. =P for ur problem, to be honest. just let it go. her broke butt cant afford a great phone like the one u got, dats why she took it. just think of it as helpin the very poor and unfortunate. and besides karma is *****. so it will get back to her, sooner or later. what ever u do, dont ever stoop to her level. cuz u know ur better than that. just let it go, and let fait take its course.
