no, it is a constitutional garentee.. for american citizens. Persons illegally here don't have any legal constitutional rights, like terrorists( people who war against america with no military uniform, and no country allegiance) are subject to being shot on the spot, military trial, and hanging.. they have no rights nor freedoms under the constitution.
