Only as ethical as it is for cigarettes to be sold in the first place. It may have some subliminal messaging involved in the advertising, but there are words that are quite clearly stated that it will kill you.

At best, it would fall under symbolism and that is not against the laws governing what can be displayed in print media (which is the only media the tabacco companies have left) Most of the government regulations are related to what has to be displayed on the packs (i.e. warning statements)

subliminal (or any other kinds of advertising) never forced anybody to do anything

as much as possible, governments should leave us alone to make our own decisions

of course, there are many cases where our decisions impinge on the freedoms of others, and that is where governments have to be involved, thats where we need laws, law enforcement, etc
