From the smallest tribunal to our highest court it seems to me that our justice system is run by a self-appointed elite who think the rest of us are too stupid to participate in the system other than as witnessess and defendents. I recommend to anyone interested to spend some time observing our courts and their typical modus operandi. I think you will be surprised at how self-serving and out of touch it all is. My concern is whether it is in its current condition by deliberate intention or because of ignorance. Maybe it's a bit of both.

Australia does not have, nor has it ever had... a justice system...
Australia has a legal system...
Heaven help us all if there really was a justice system and it worked... Who would want true justice...??

Apathey and ignorance are two main reasons. It the lawyers' system and has nothing to do with truth or justice. In "lawyer world" reality is suspended in favor of procedure. Another reason is that the people of this country like laws to be enforced against others but not against themselves. As long as its someone else taking the heat they don't take concern and don't monitor the system. Lawyers make an astronomical amount of money off the state defending those who repeatedly victimize us. We, the people, tolerate it and ignore this ripoff as long as we are not having the law enforced on us. Too bad too.

The court system is out of touch for two reasons and you've hit them both on the head (deliberate intention or because of ignorance). Certain laws are out of touch (manditory sentancing, the drug war, political wedge issues like abortion); most of these ddeal with the criminal system. Certain others deliberately screw it up (limits to big business penalties; court proceedural laws, etc.); most of these are civil (people suing others).
Most of these problems won't be changed unless we have more selfless advocates fighting for these issues.

Its totally deliberate. Those in power will create a system that benefits themselves, protects themselves and keep subordinating others. us participating is a serious threat to them, we would definetely have a different take on issues which would put their structure of the system to serious scrutiny.

Have you voted for any judges and know why they were good for the job?
When citizens do not care to be vigilant - systems 'corrode'.
