My ex-husband and I have joint custody with me as the primary caregiver. He can see them for one month out of the summer and some holidays. I live in North Carolina, while the other parent lives in Alabama. I want full custody. What rights do I have and how do I handle this?

i live in alabama, and i have the same issue with my ex in a different state, its called an interstate case, and if you want to change the arrangement, you have to go and file in the county that the decree was set in the begining.then you must prove why you deserve full custody, because the distance does not matter, he has to have do something to warrent this.you must file the paperwork in the county it was decided in, and then he will be served.then he will have a chance to file a response, then you will get a court date and go fight it out, be carful cause he can do the same thing once he gets to court, he could file for custody as well,

Even with full custody, he still will have the same right as he has now. He is still entitle to see his children one month out of the summer and on holidays. Now when all this happen is still in your court. I have full custody but I live in the same state and he gets them every other weekend, holidays and during the summer.

is the case in alabama? if so its much like the rest of the states you would need to prove somekind of defalt on his part and unfourtanally deliquint child support usually wont be enough.

He has to give you full custody or you have to prove him unfit. That's the only way.
