My husband had an account with Sears and now he has been sent to collections. They are saying that because sears is a bank,... they are willing to sue us and take us to court. Is that true? How can we overcome it? Please help me. The payments are outragoeus and cant afford the settlement amount. Please help me.

My wife was sued by Citi and taken to court. She had low income. They could only take $50.00 a month...and the interest stopped..and they will take a less then settlement next year.

Go to court and let them try. Spend your payments on you and your family first. The wankers will always try to get blood out of a stone.

Don't bother contacting them, they will want WAY MORE then you can afford.

Collections people are ruthless. Whatever you do, don't be emotional when you talk to them - that just sends them in for the kill. Life is tough and financial crap happens. I agree with another poster - take care of YOU first. Then, just tell them what you CAN afford and if that's not good enough for them, simply tell them that's the best I can do. Don't lose any sleep over it.

I work in collections (smaller company) and what I would do is contact Sears and see if they will work with you for a payment plan. good luck
