Depends on the situation. If you know the name of the biological father, technically you are supposed to add it to the birth certificate but in the case of birth out of wedlock it is a personal choice as to what last name is used. You can give a child YOUR last name or the name of the father. legally I think they go with the last name of the mother unless the father is known. Mine was my mother's last name because my father was not in the picture. There are a million possible situations for this kinda thing but the law is getting more determinative all the time so depends on that as well. Hope this helped. If the parents are married then the father...if not then the mother. Unless the mother is ghetto and gives the baby the fathers last name. I believe that if you want ur kid to have your last name then you should be married to the mother.

Father.My parents were married when I was born and were married 33+yrs,up until his death.When I had my 1st daugther,I wasn't married.I gave my child her fathers name and we got married 2 yrs later.Hope this helps.
