My friend went into a carpet place , and the male secretary took her into a secluded area ( she thought he was going to show her samples ) and pulled his thing out at her and asked her '' what do you think about this ? '' . If she says something can the owners legally decide to not let her buy carpet from them ? Can she press charges if he is not fired ? This is disgusting and unacceptable !

First of all, does she have any proof? If not, there isn't much she can do, it's only hear say. As for refusing to sell her carpeting, they have to have a better reason than that.

She should however let his employer know about it and they can find ways to see if he does it again.

If your friend can find other people who have had a similar experience, she may have a leg to stand on but if not, she had better be careful as to what she says because he can charge her with slander.

I'm sure the employers do not know of his behavior or he wouldn't be working there. This person broke a number of laws when he chose to expose himself. First off, the police department shoulder be notified followed by the owners of the store where this occurred. This person is apparently mentally crippled and could prove to be a danger to others if he should take his behavior further than just exposing himself. Could your friend live with that should that occur? I would not be concerned about whether or not I would be allowed to purchase carpet from this company, there are other carpet stores your can frequent. Plus I would not want to frequent a store where a person of this type was working.

yes he can get fired and if your friend wants to take it further she could sue the carpet place for indecent exposure and other things. And the carpet place cannot legally not sell you carpet. If you reported the action that took place they should fire him in front of you and tell you they are sorry. If she brings up sueing and how crude that act was on their part hiring such a ignorant person they would probably make canges to your order to better fit your needs lol.

Id say use it againest them. I hope that helped.

Yes that is totally wrong and unacceptable. How old is ur friend? Tell her to call national sexual harassment hotline and report it. She has to. If she has witnesses that would be better too. Dont tell her to call the manager of the carpet store. They would only deny it and be prepared when your friend presses charges for sexual harassment.

Hell Yes!

She should immediately report this pervert to the store manager and the owners of the store. And...she should do it...IN WRITING.

She should also go to the police and file a sexual harassment complaint against this individual. If he did this to her, it's probably not his first time doing it. who knows how many other woman he may have already exposed himself to. If nobody says anything, it may progress to something worse outside of the store.

AND...

if the owners choose to side with this piece of trash, she should shop elsewhere for her carpeting.

Yes, you can file a private lawsuit, but you must file a charge with EEOC (United States Equal Employment Opportunity Commission) first. Here are some common questions and answers about filing a charge with EEOC:

Here some links about what to do if you are sexually harassed at work:

Remember, it is illegal for your friend to be punished at work, in any way, because of filing a complaint. It is also illegal for no action to be taken.

Indecent exposure. Have your friend tell the owner and try to get a break on the carpet.

She can definatly press charges and the employee will most likely be fired but that is up to the owners.

she should tell the owners and if they get mad buy the carpet somewhere else.It is hard to prove something like that unless someone else has had similar experiences there or somebody saw it.I would turn the guy in to the cops,he obiviously is sick and who knows you may save somebody or some child from harm.

She can press charges for indecent exposure and if she notifies the carpet company their employee will be fired.
