them? case in point Andrea Yates murdered 5 children and is only tried for 3 of the murders. why?

It leaves the prosecutor with an option to try them on the other murders later if the earlier case gets thrown out for some reason.

In her case, if it looks like she's going to get off, they can initiate charges against her for the other 2 murders.
Remember, there is no statute of limitations on murder.

In the case of Andrea Yates, it is very difficult to understand why she wasn't tried for all five. After all, she admits to killing all five.

Generally, though, the prosecution puts on the case they think they can win. If they try to do too much at once, it is very difficult for the jury to sort it all out. So, they lead with the best cases. Then if something goes wrong in the trial, they can try the others if they need to.

Andrea Yates will be in court again for the other murders this gives the prosecuters two chances at putting her in jail without having to worry about double jeopardy.

What ever happened to people like Jack Ruby who took vengeance into their own hands? I mean, I'm not ADVOCATING violence, just lamenting the complete lack of modern-day avengers of justice.

Case in point: Andrea Yates. That ***** could conceivably be walking the streets in six months after cold-bloodedly murdering her FIVE children. How is that even possible in this country?
