I'm the opposite ( father looking for custody ) of your position. As much as it kills me to say it you need a lawyer. Trying to understand and apply the laws for any custody question is mind boggling.
I tried to talking w/ the primary care giver ( his mom ) in an attempt to resolve the issues at hand but when she wouldn't even consider it I was left w/ no options but through the courts. When i went to file my request I became overwhelmed w/ all of the forms and information they needed from me. I had no choice but to hire a lawyer to ensure that I had not missed any options that were in there for me.

If you are looking for full custody instead of shared custody you will have to prove that the custodial parent is endangering the welfare of your child otherwise shared custody is likely the only thing you can get. Good luck.

I am a non custodial father fighting for custody. The laws completely depend on the state. I know many states changed the laws effective Jan 2006. so as far as how the courts work it is hard to say.

Its pretty unusual that the mother doesn't get custody... I assume the courts explained why you didn't get it... If you can show the court that those reasons no longer exist, you should be ok

First: Start Documenting EVERYTHING! Write everything down that happens with dates and times. Get a voice recorder (Best Buy 60$) and record your phone calls with him. Get a camera that records the date on the pic and use it when needed.

When your court date comes you want to be able to say: " On July 24th Mr. Smith took my kids and refused me visitation until Aug. 5th of 2006. I have been recording our phone calls and have him clearly stating that he is not going to let me see my kids blah blah blah"

You want to be specific as possible with the judge! I used everything above to win my kids back and it worked, including the voice recording. He cant deny his own voice and you can say you recorded it to remember exactly what was said between you. i have a horrible memory, i had to have it.

well im not into trying to get kids back. but for you to get your kids back it all depends on why was it that they were taken away in the first place. You need to be able to provide them with a home, you need a job, be drug free. and just prove that you can be the better mother now.. good luck

i think u will get him back if u a have a good job and a house and that u can take care of him and there is no abuse on u in the past
