No, but I just took a medical malpractice class

The poster below is not quite correct

some states require a doctor to certify that there is a reasonable probability that there was medical negligence beore you can file suit

at trial, you will have to ind a doctor to testify 'within a degree of medical certainty' that there was medical negligence

in addition, the negligence does not have to be the sole/exact cause of the injury. just a contributing cause

your best recourse is to find a lawyer which only deal with med mal, they Willl look at the case and see if you have merit, now it is not cheap a med mal case so if they take the case they wil probably want 1/3 of the award, if they will not take the case then you will have to find a doctor who can certified that the sole/exact cause of death was medical malpractice

In my case, it's the doctor who was our client. the complainant filed a case against him for malpractice and criminal case for the death of the child...
