Meaning all my nieghbour's effluent flows down into my property? At the moment my problem is cement slurry I have a thick crust of cement effluent in my plants (obviously he's been cleaning his cement mixer out and sent the slurry my way). In the past, things have been limited to getting so much water its made my garden soggy and lots of detergent. He must have OCD he never stops hosing down his patio. I have spoken to the council and they say they will investigate.

MY concern is that soon he'll be building a new patio further up the garden. Is there anything I can do to prevent the same reocurrence, especially since their 8 dogs are going to have even less space for their uknowwhats after the extension work has been completed on their property.

Is cement slurry considered to be environmentally hazardous? My son's football was lying in it and it had a thick coating of the stuff.

As long as the patio is on his property, there's nothing you can do.
I would suggest some sort of decorative retaining wall between your property and his to hinder the flow of slurry. Maybe sinking it into the ground about four inches would hinder it from flowing under the wall.
Have you checked with the city you live in about how they feel about him cleaning out his cement mixer in his back yard? They might be less thrilled about it than you are.
I can't say if slurry is hazardous, but it's something I wouldn't trust. Throw away the ball and get a new one.

The Patio and its construction are not illegal,As for the run off of water that is an environmental issue.If the slurry is damaging your property or surrounding areas and this can be shown to have been caused by your neighbour they will be responsible for its repair and upkeep and/or could be fined.
If they have applied for planning permission you could object to its construction until these faults are rectified.As for the dogs,it appears there living space has been greatly reduced so contact the R.S.P.C.A. and remember this person is not doing anyone any favours You ,Himself or His dogs.

1. He violated a environmental code- he is required to put up a plastic barrier to dust, and run off for any excavation work- he did that setting up the concrete.

2. You cannot change the Lanscape to create run off onto an ajoining property.

3. Send him a Certified Letter to clean up the mess and not cause such to happen again, or you will sue. Get Code Enforcment out there and 8 dogs is probably illegal unless this is Rual and even then it might be illegal.

I agree with the above answer, contact a Solicitor.

However you do mention that your neighbour's 'effluent' flows into your property; do you not have a party wall or fence or if not, could you build one?

If under city code, drainage is required off neighbor's premises. If there is code, you may have to hire an atty. and have him Red Flagged by city inspectors. You may not even need an atty.

The neighbor can be required to pull the patio and /or install proper drainage.

The council will take for ever to do anything about it.
Contact a solicitor, he/she will know a lot more about this than the local useless council.

First thing is you have to speak to them, you cant go taking action like this without speaking to them.

But it is rude that this run off does affect you.

I would also recommend talking to a lawyer, laws are different all over so it is hard to know.
