Did he coerce? (Threaten to fire her? Threaten to hurt her?) If he didn't force her or coerce her, and she did not give an indication she didn't want to have sex, I don't see how anyone could argue that he raped her. Unless there's more to this story, I don't see how he could possibly be convicted of anything.

Your friend is a nut case. If they were both under age or both over 18 then it is not rape and I hope she doesn't f--k up some guys life over her immaturity and sturdiness. Many women feel guilty after words and want to blame someone else when the blame is looking at them in the mirror. Let the guy alone and chalk it up to a lesson learned in the school of hard knocks which teaches life's toughest lessons.

The band "Rush" once sang, "If you choose not to decide, you still have made a choice."
By not saying "No," your friend made the choice to have sex. I don't think any prosecuter in the country would pursue a rape case.
The best thing you can do now is be supportive to her, and if she is willing, get her into counselling. She needs to learn the self confidence and assertiveness to prevent becoming a repeat victim.

It's not rape. She shouldn't have done something she didn't want to do, she should have just left.
It's only rape if he held her down or put a gun to her head and forced her.

Sexually molestation. No means no, regardless of whether it is sexual intercourse or even just touching. And even if she got off on it/or said yes to appease him, it could still be entirely his fault. Good luck.
