40k is great for a set of brakes and if they passed inspection then they were ok when you bought it and you wore them out. This is perfectly acceptable.

How long brakes will last depends on many factors, and some cars have problems with brakes even at much lower mileage.
So, it's totally not unreasonable if brakes fail at 40,000 miles

You might just need more brake fluid. If the brakes are worn out then get them repaired before the disks get damaged. If the brake pads wear down too far they eat into the brake disk, (rotor). Depending on the car replacing the rotors could cost a few hundred dollars more.

If you bought the car from a dealer then it is reasonable to go back and ask them that question. If you bought from a private party then you are pretty much on your own. It never hurts to ask though. Be sure to get new brakes no matter what so you can drive safely.

No, that's normal. My wife replaces hers every 25,000. some cars are worse than others. The good news is that you might go another 40,000 before needing them again. (:

if you buy a used car with that amount of miles on it, you can expect to start replacing parts like that.
