i am on maternity leave at the min, i work in a team of 4, 37 hours per week, we work in twos opposite each other, ie when where at work other 2 on days off n visa versa, so i went to boss n told them i would need cover till i came back from maternity n they got someone, only now they are saying she is permenint and they are going to put me elsewhere when i come back, give me the same contracted hours but not with my team even tho the girl they covererd me with is only contracted 35 hrs, me and my team are all 37hrs why wont they just put me back where i was? have i got a chance? should i fight?

If you have worked there for more than a year you have rights under the FMLA act. If you have been there for less than a year, there are no requirements.

Your boss has a right to do it but i think your just falling foul to gossip don't let it worry you , if when you go back your somewhere else who's to say it might not be better , We all fear change and in your condition more so but are fears are rarely founded in any real threat . Relax coz you won't have much time for that when the baby comes .

you have gotta investigate this further, the citizens advice bureau will be able to help, but actually, you are gonna have this lovely baby, and perhaps you may love your job, there could be a better one out there for you when you decide to go back to work! good luck with your baby hunny, try to get this sorted before she is born just so you can enjoy your time with her when she arrives. (force of habit calling baby a her, just cause my last one was a girl!).

If your contract only states you work 37 hours, then your work can place you where they need you as long as they give you your contracted hours.

Get yourself down to the Citizens Advice Bureau and get the facts from them - don't leave it all to chance. Hope your baby is perfect and you don't waste these precious next few months worrying and allowing this to spoil it for you :0)

A company is required to give you a job when you come back from leave, doesnt have to be the same one you had. Sorry.

i would go and see someone at the citazens advice if you have 1 near you otherwise if it really bothers you seek a solictor... i dont see how they can just chance you job title because of maturnity leave

I don't think that you can legally demand your same position back. If they maintain the same hours and same pay, then they are within the law.

this happened to me, my work mates went on a go slow when i came back, Norwich union r sods, i didn't get back into my team, but my best buddy came to mine, i didn't have a leg to stand on
