Take a closer look. It isn't just a generic "skull & crossbones" symbol.

The Skull has gold teeth...exactly where Cap'n Jack does.

And it's wearing Jack's distinctive red bandana...complete with gold coin dangling from a short string of beads.

It's him.

I'd know those eyesockets anywhere.

Yes, actually, I have noticed that. I have a feeliing it was done intentionally for the first movie because of when Captain Jack gets cursed after stealing a coin (you know you see him as a skeleton). It's hard to tell right now if Disney keeping the skull for the second movie artwork has any deeper significance or not.
Interestingly, if you look at the original two disc version (I don't know if there are any others) of the DVD you will find that disc one has a picture of Captain Jack Sparrow on it and disc two has a picture of the skull on it, only the gold coin is hanging from the opposite side, hmm....

how do you figure that? it's just a skull, like the skull in a skull and crossbones. Jack Sparrow's? no way...
