Sorry, but the pre-nup comes before the wedding. Any division of property from now on would be from the divorce court, if you end up there someday.

Just tell your spouse, in reality s*** happens and it is a good precaution for that just in case. My fiance and I have talked about it and we do not plan on ever splitting up but we also take into consideration that we cannot predict the future.
