I don't believe adultery or sexual relations between a married man and a woman other than his wife is a crime in California (if so, swingers would be arrested left and right)
It is not even "grounds for divorce" as some mentioned, however it is something that could be considered towards grounds of "irreconcilable differences." Irreconcilable differences are any grounds that the court determines to be substantial reasons for the marriage not to continue.

If a married man is going to have sex with women other than his wife, why doesn't he give his wife the courtesy of a divorce first? Then he doesn't have to worry about committing a crime in man's or God's eyes.

A cheating man in California isn't going to do jail time for his affair, but the courts are pretty tough on adulterous men. California thrives on law suits & divorce cases. If his wife finds out and takes him to court, then he better be prepared to lose it all. Alimony isn't cheap!

That's a pretty costly piece of a$$ if you ask me... his girlfriend better be giving some world class sex!

No its not. California is a no-fault state. Therefore you could do almost anything, and its not gonna matter if you got a divorce. You can only use it as a personal threat if need be.

It might be a moral crime depending on your spiritual background. But it is not against the law.

It is not a crime punishable by law unless you are in the military. This is more of a morality crime.
