btw this is not a ? about me in any way my hunny is not in Iraq nor am I plus I am only engaged but I have a friend going thru somthing regarding all of that

Each state has diiferent laws on what can be used to prove adultry. You will have to see what your state deems as adulturous behavior, that will allow this person to file for divorce.

In most states, adultery isn't grounds for a divorce. If the spouse that's cheating is in Iraq, I guess that would be difficult to prove unless they are charging things to a joint account that the other spouse has access to. Or find letters, pictures, or another soldier that will give up the ghost.
On the other hand, if it's the spouse that's not deployed that's doing the cheating... the same items could be used.. even the other soldier they might be cheating with...
In order to even present it in court, it can't be something someone told them they saw kind of stuff. that's hearsay and not admissable in a court of law.

If the cheater is the soldier: To prove it to the military unfortunately you will need to have concrete evidence- an eye witness, a video that has time stamp, or a child born from the act. Email can sometimes be used if it states clearly that physical sexual contact has occured between the people. In the end it will be up to the soldiers unit as to how it will be handled.
If the cheater is the spouse: it depends on state statute and law

i am living in a military town and it happens all the time and if this person that is over seas is being cheated on i think it is best that they dont know it they will know soon enough believe me and i think it is so sad how can someone that you thought loved you cheat on a person while they are in a far away place and fighting for our lives and their safety and they cant do anything about it but i have heard stories where the guys find out the wife is cheating so they let there buddie know it while there overseas it is devastating to them and visa versa so dont worry about proving adultry because they will find out soon enough believe me

To prove it? All parties will be subpoenaed and it will go from there.

Did your friend cheat?

That sucks that someone would cheat while one is in Iraq. That is just down right wrong if you ask me!
