It depends on how the child fell. If the window was left open and the child was unattended, then it is the care giver's fault, whether that be a parent, babysitter, etc. If a window falls out of it's frame then it would be the building owner's fault. If a dog knocks the child through the window then it would be the dog owner's fault.

The parent(s) or guardian. They are in charge of making sure no harm comes to the child in any way possible.
This could include putting screens or bars on the window, teaching the child about what is dangerous, and monitoring the child's activities.
