Secondly, if you have 'nothing to get' you don't have anything to lose, either. There are a number of resources for do-it-yourself divorces (I don't recommend them). You can shop around and find an attorney you like and that attorney should be able to petition the court to have him pay your attorney fees, child support and maintenance/alimony.

So, no matter where you are when it comes to kids being taken care of in a divorce, it won't matter whose name it's under. He's responsible for his kids care as much as you are, so don't let this stop you from getting your freedom if he's committed adultery which is the only means excepted by the Bible. Other wise you need to make sure you've tried every means possible to have your marriage work before going to get a divorce.

First of all you need a lawyer. If the kids are his, you are going to get child support no matter where the money is (real name or not). You also can ask for alimony as well as. Providing that you did not sign a prenup. The main thing is get a good lawyer. Good luck.

OK!!!!! i am so sick and tired of hearing ppl say that they are in an unhappy relationship but stay because of the kids and money!!! I am only 25 and I have a 4 1/2 year old son who I am raising on my own!!! I work full time and his father does not give me **** ALL!!!! My son has been so much happier since his dad and i split up because he was able to sense the stress between us. He still sees his dad and that's lall that matters. Get a job and GO!!! Don't spend your life in a miserable marriage...it's not good for you or the kids and he will still have to pay you child support!!!!

Any property that you have acquired DURING the marriage is 50% yours. In a divorce settlement, you'll get your 50%.
Any property that you or he acquired BEFORE the marriage is considered separate property. In a divorce settlement, he won't get yours and you won't get his.
Separate property can become community (joint) property if it has become "comingled". For example, if he bought the house you live in BEFORE the marriage, it is his separate property. But, if you have jointly made the mortgage payments or have jointly remodeled the house, then at least some of it, possibly all, could be community property.
Lastly, if you have physical custody of the children, you WILL be entitled to child support.
To get a better understanding of the issues as they apply IN YOUR STATE, you need to consult an attorney.

You married someone under a false name? That wasn't too smart.
As long as you can prove that his false name is an alias for his real name, it shouldn't be a problem.
If you want a divorce, and the reasons are based on violence, then money shouldn't keep you from it.

When you go to court for your divoirce tell your lawyer or the judge his real name and he has money and you want alimoney to support you and child support for the kids. They will more then likely give you a decent settlement for now regardless of his name he has money out there.

Well if you take it up with the Child Support Agency and even though the money is in his real name, he'll still have to pay support for the children if they are his.

I'm confused. If you are married would you not be married to the person (real name). If he used another name then you need to contact a lawyer immediately.
