im not talking put it in a trust account for the landlord till an eviction trial is resolved. im talking withold rent nad not have to pay it. but it cant be habitability cause the buildings actually pretty nice.

There is no reason then. If the place is in livable conditions, then you must pay your rent. You signed a contract stating that would pay a certain amount each month by a specific day and would continue to do so for a specific amount of time (usually 1 year). You have no good reason to not pay your rent so any judge will determine that you must pay and then you will owe late fees which can be hundreds of dollars. Realize that landlords have a job too and you not paying your rent would be like your employer saying that...despite the eighty hours you worked in the last two weeks, he just does'nt feel like paying you. No reason...just doesn't want to pay. Not fair is it?

There is no legal reason to withhold rent. Even if you fix something in the apartment and withhold the amont you spent, it is illegal to do.

More to the point, if the place is pretty nice, why are you not paying your rent? Are you just looking for a free ride? Why are you getting evicted? You should give more details in order to get better responses. Although, I must say, I have a feeling you can't give more details as it won't shine a very nice light on your actions, am I right?

There is nothing legal about withholding your rent. In fact, even if you have a legitimate grievance, you still have to pay the rent until the grievance is resolved.

You are renting something that someone else owns. If you do not pay for the privilege of renting that space, then you will be evicted. After an eviction is on your credit report----and it will be---you will be hard pressed to ever be approved for another lease.

If you don't have a lagitamate reason, such as the landlord is refusing to fix things, isn't paying certain things, etc. you have to pay your rent. If you don't pay your rent your landlord can evict you after 30 to 90 days depending on what your lease agreement states.

You're probably just going to have to pay your rent. I know it sounds difficult, but if you dont pay, the apartment will send creditors and that will ruin your chances of getting a car, house, etc.
