you can file next day...
but CA has a 6 month period before the case will even be heard
and unless you have been married less than 5 mons, have no community bought assest and no children, then you must file a contested divorce, and not an uncontested one.
the 6 mon BTW is a residency requirement, so if you were less than 6 months living here, you cannot file until then.
CA is alos a no fault state.. mean you can file and oly can list 2 things for filing, irriconcilable difference ( what 99% of the people file for ) or a fradualant marriage ( like the other person was not sane or incontrol of there facilities at the time of marriage ), since the fault clause ws eliminated a long time ago, this mena cheating is not a factor, but you can divorce siting only the "difference " in the forms

It depends on if you have kids. Divorce isn't something you can rush. My sister got divorced in CA and it took about 9 mo. (with kids)

You should only get a Divorce if one of the three A's are
present.
