Miramax was obviously involved in the process. At the time, the task would have been beyond PJ's financial reach and would have been a complicated legal issue even for an experienced copyright attorney.

Was PJ's script written prior to acquisition of the rights? If so, how influential was that to the owner? How do you find out who owns the film rights to a given book? Is there a super-duper secret list somewhere or is it all inside info?

The article linked below has the back story. JRR Tolkien sold the rights, but they reverted to his estate. They were subsequently re-sold to Saul Zaentz

I think it's all on JRTolkien who has the copyright on his book, but since he's passed away, his family members could have renewed the copyright. If not, after a certain amount of time since death, some works of art could be used by anyone. I think it's called "public domain" if this happens. Just like Shakespeare, anyone could just reproduce his plays because no one has copyrights with his works.
