I was at a drive through car wash and my car got off the track. I got panicked and got out of the car, and before I could walk to the exit, the dryer turned on. I was wearing sweat pants and the force of the air blew my pants down. People waiting outside saw me and started laughing. Would I have a case against the car wash, since the faulty equipment forced my vehicle off the track which ultimately led to me getting humiliated in front of a group of people?

A lawsuit like this requires some basic elements to be met: 1) duty; 2) breach; 3) causation; and 4) damages.

I won't give you the full legal analysis but you kind of lose on all four counts. The car wash folk did nothing to cause your humiliation. You did it yourself. And to top it off, your damages are not legally supportable. Embarassment is not actionable.

Sorry.

Oh, and don't be so quick to sue. And people blame lawyers for this nonsense. Take responsibility for your own actions. Jeez. Be a man.

No, if your car came of the track, you could have driven out of the car wash or back up over the track, either way, the car wash would not be found negligent in a court of law, which you would have to prove before claiming any punitive damages for humilitation. Now, if the car wash attendant yanked your sweat pants down in front of a crowd of people, then yeah ... you could sue for humilitation.

normally no you can't sue. you have to be able to show how there is a lose of property, of pain and suffering to sue on this matter. and no being laughed at does not apply here. you can get a lawyer who will make you pay a retainer of 1000-5000 dollars and that doesn't mean that you'll win. In most cases like this most judges will say IT was poor judgment on you part for getting in that positions and they will dismiss you case. but the lawyer will still want his fee. Try it if you want but it's a bad idea

That is not enough reason to sue. You would just be clogging the system with your whiny crap. Too many people like you abuse the legal system for things that normal people have to learn to live with. IF the humiliation has made it impossible for you to live a normal life, has instilled agoraphobia within you to the point that you cannot leave your house, thus destroying your social life and causing your gf to leave you, causing you to miss work and be fired, then you MIGHT have a case. Otherwise, get over it!

you will have to go back and check for signs stating something to the effect of "do not exit the car after entering the car wash." if any signs like this exist, no you can not sue and recover anything. if there are no signs, you can attempt litigation. it might be even more humiliating admitting you exited your vehicle tho.

Yes, you have a case, but I wouldn't go with it. 1st there wasn't no bodily harm, 2nd I bet if you go back to the car wash there be a sign for stupid people to stay inside there cars, if it's an automatic drive thru car wash, there an attendent on duty. Is this the 1st time you been laught at?

You can sue for anything. Winning is another matter. Get over yourself. Everyone gets laughed at at some point in their life. We have set up and entire industry which feeds off others, creating nothing for the economy.

If you car was damaged, ask the owner for reimbursement for damages. If they don't pay, sue in small claims. You got out of the car so whose fault is is anyway? Yours....

You can sue but only if you wish to publicly humiliate yourself more... and the worst of it is that I think your suit would get tossed before going to court.

You would have to find a very good lawyer who would take your case for personal amusement and the judge would have to be his father in-law to even have a remote chance of winning.
