I have a friend that was fired from her job the other day for having a myspace account. I do know that it is legal for a company to terminate any employees who are leaking company information on the internet. I can assure you that this is not the case because my friend works as an assistant manager at a grocery store. She was at work when she was suddenly called to the back, where a printout of her entire myspace account was thrown down on a table in front of her. The owner of the company then told her that he did not want "someone like her" working for his company!!! I do not think that is legal is it? I reviewed her accout, and all it has posted on it is some quizzes she had taken online which included references of alocohol consumption and sexual preferences. I do not think that it would really make the company look bad because she is over 21 so it is legal for her to drink and have sex! Does my friend have any legal rights in this case...please HELP!!!!!

I also understand that there are at least 3 more people still working there that have myspace accounts and they admitted to their employer that they had them, but they have suffered no consequences as of yet...

I also know that it is legal to be fired for bloggin while working but again there is no internet connectin what-so-ever at the store she works at so all of this was written on her own time at her own home!

I don't know for sure. But it sounds like she might have a good case, if she didn't put up any information that could damage the company.

Technically, most states allow employers to fire employees at will, barring, of course, descrimiation, etc.
If she believes she was descriminated against due to something posted in her myspace page, she may have a case. Otherwise, she should move on and be more discreet with what she posts (or at least not put her real name, etc. tied to the page)

A company can fire someone for pretty much anything. If she wasn't under contract (which I'm pretty sure she wasn't) then yes, it is legal. They didn't fire her for being a woman or anything. They fired her for being a party-animal. And yes, a company has the right to do that. Unless they fired her for being a lesbian or some other "protected" class, and she can PROVE that is why they fired her, then no, she doesn't have any recourse.

Yes, it is legal. I keep telling people, don't write, don't speak on anything that can come back and bite you in the ***. It may prevent her from finding another job as well. She may want to contact the Labor Department though since it does seem pretty bogus.

Unfortunately for her friend, it's not likely that her employer has broken any laws. Sexual orientation is not a protected class in Texas, meaning that it is perfectly legal for her employer to fire her for (I assume) being gay.
