Ok, I'll go against the grain here, but at least I'll be honest. Yes, I would kill the guard. You are basically asking if I would take a life to spare a life if the life spared was my own. Yes. I would. I would also do the same for a member of my family.
See, I guess I see it differently, because I think the guard isn't truly innocent. They're holding me, an innocent, captive for a crime I did not commit. Whether they realize it or not, they are guilty of taking my life away from me an inch at a time. And for that, I could kill.

Perhaps.
we are all guilty of sin and will sin if given the right opportunity.
I would hope to do the right thing, but I don't know.
Can't answer it. Not in the situation.
Now is his life of more value than yours? But others will say so, is this the legacy you want for your family?
Clearly not, for all life is of value and here is why the decision is into play when it should not have to be made at all.

Do the ends justify the means?
It is moral to kill someone to prove my innocence? I could easily be found innocent of the old crime, but guilty of the new crime.

No. Then you will actually be guilty of the crime of murder. Anyone who would sacrifice another human for their own freedom doesn't deserve to be free.

I would hire an excellent attorney to find a technicality - such as DNA evidence - to get me off.

Yes, but I would just knock him out. If I can get away with him dead, I could get away with him just unconscious. No need to kill.
