Presidential succession is covered by both the Constitution and Federal Law. If a President dies or resigns he is immediately replaced by the Vice President. Under provision of the 25th Amendment to the US Constitution, the new President is authorized to name his own Vice President (subject to a simple majority vote in both houses of Congress).
The same provision applies if there is a vacancy in the office of Vice President. After its adoption in 1967, the succession provisions of Amendment 25 have been used twice:
1973, when Vice President, Spiro Agnew resigned amid charges of corruption during his tenure as Governor of Maryland. President Nixon swiftly chose the Republican minority leader in the House of Representative, Gerald R. Ford to become the new Vice President.
1974, when President Richard Nixon resigned the presidency amid charges of coverup and obstruction of justice in the wake of the Watergate breakin. Upon President Nixon's resignation, newly appointed Vice President Ford assumed the presidency, and promptly named former Governor of New York, Nelson Rockefeller as his new Vice President.
The only time the congressional Act of Succession takes effect is if there are simultaneous vacancies in the Presidency and Vice Presidency (a highly unlikely occurance). Under the Act of Succession, if executive offices are simultaneously vacant, the presidency first devolves onto the Speaker of the House of Representative. Then onto the President pro tem of the Senate.
After these two members of Congress the presidency would devolve onto the members of the presidential cabinet, based on the seniority (meaning, age) of the departments, with the heads of those departments created first having precedence over those departments created in more recent times. Thus, because the Department of State was the first execultive department created, the Secretary of State has precedence over all other in the Cabinet; and because the Department of Homeland Security was created last, the Secretary of Homeland security is at the bottom of the line.
