go to EBay and pay pal if you used them that is.
File complaints...
If you used a Credit Card wait about 2 weeks to let EBay sort it out, if they dont solve it, ask your Credit Card company for the money back, they should give it to you.

eBay have detailed procedures about this. If they did not, people would not use eBay. eBay do take people to court if they scam others. Anyway, you don't know if that is the case yet.
If you read eBay's advice on this, your first step is to get in touch with the seller. eBay will disclose their private phone numbers to you. If this doesn't work, you start a dispute procedure with eBay.
If you paid byPaypal, they do operate an insurance procedure too.
If you have bought internationally, and the seller can show proof of posting it is possible that your item has been delayed by Customs. This could add some time before the item is delivered, and you could find that you need to pay import taxes too.

If bought on ebay with paypal you can request to have it investigated. Ebay is a perfect tracing venue contact them about the incident. Remember to print your confirmation by using print screen if you can not get a regular print out. Always check the persons transaction history also.

how long did you wait, as it can take 2 months sometimes, contact the seller and ask when he sent it, then contact your local post office as they may have it, but not delivered it (happened to me a few times), if nothing then contact ebay by going on the dispute console, on the bottom left side of the menu.
They can normally help

You can go back to ebay and file a complaint. You follow the procedures outlined on their site.

Give him a bad feedback and write nasty words there. Then report to the Ebay. They will help you.
