My wife is not cooperating & doesn't want me to have joint legal custody. She is making up all the horrible stories from the beginning to now. In Illinois if wife doesn't want joint legal custody, husband can't have it? And GAL is very very biased lawyer. What is my option? There will be a pre-trial conference soon.

ehhhh, Do you have a lawyer? If not you may be fu*cked. I know thats kind of blunt but my boyfriend just went through this. the gal talked to the parents and child. the pre trial conference was last thursday. well no one showed up and he found out he only has supervised visits now. so, if you dont have a lawyer, and even if you do, be prepared for the worst. if you lose custody now doesnt mean that you cant go back and regain it in the future.

*however at this point my bf is so mentally exhausted that he doesnt know when/if that will be.. :-[

ex wives can be pretty psycho and will do crazy things.

i hate them. now im definately going to take my time with my current mate

good luck.

Ok....the only reason she doesn't want you to have joint legal custody is because if you do it will lower your precentage of support by anywhere from 5-10%. The GAL is only there for suggestion....it is left completely up to the judge and all the Judges are aware of this factor.
Have your lawyer put you up for a drug test, alcohol test and assessment of mentality to prove that you are very fit to have joint legal custody. I went to law school in IL and unless it has changed in the last three years, unless she can prove differently, the Judge really has no choice but to give you Joint legal...

Good Luck

well, at that point all you can do is TRY HARD. You need to get a good lawyer, fight with all you got and don't give up, and even pray. Prayer has a great impact, and expecially have faith as well. Things will work out for the best and everything happens for a reason. :)
