My fiance and I have lived in this apartment since November and there is a new tennant up stairs who is constantly loud and throwing parties all the time for days straight. When I first asked her to quiet down she screamed at me. When I called the Landlord about this she then called the tenant who came downstairs with all of those people and screamed and harrassed me. And at this moment she is still being loud, rude, and inconciderate. What can we do about this? PLEASE HELP ME!!

Is there anyway to get out of the lease because of this? I really like this place though. Thank you all for your advice and help.

I would also call the police next time it happens. This will help your case. Next get in contact with a lawyer, I use a service called Pre-Paid Legal Services, and I love it. I have had it for over a year and anyting something like this comes up I know I can call a real lawyer and get real advice. All for $17/mo in my state. Plus there are lots of other benefits as well.

I've lived in an apartment for many years, and we all know neighbors come and go. Sometimes you get good ones, sometimes you get the really crappy ones.

One thing I've always stuck to is to NEVER talk to a neighbor about their loud music/parties/whatever. The reason being, you never know if they're going to be a total lunatic, like your neighbor seems to be. People aren't stupid, if they're blasting their stereo, with 300 people in their apartment and it's 3:00am, they KNOW they're disturbing their neighbors - they just don't GIVE a f*ck.

In your lease, there's a clause that reads you have the right to quiet enjoyment of your apartment. Not much you can do to enforce that clause - until a certain time, usually 10:00pm, with the time stated in your lease. No way I'm going to risk getting MY head bashed in by some loudass, crazyass neighbor! I take that crap right to the leasing office. You can make an anonymous complaint. Just let the leasing office staff, or your landlord, know exactly how your neighbor is making your life hell. Make sure you document the date you called and what the leasing office said they would do to correct the problem. Usually they will call the lunatic neighbor first. If that doesn't help things, they will usually write the lunatic neighbor a letter, stating the behavior that needs to stop, with each additional letter letting the lunatic neighbor know that if the behavior doesn't stop, they can and will begin eviction proceedings.

Stay on the leasing people. Let them know you are not going to tolerate that crap from an inconsiderate neighbor. Be nice, but firm.

Good luck to you. Crappy neighbors can make your life sheer hell.

Honestly, I would suggest a Pre Paid Legal plan. You would have access to an attorney for a very affordable monthly rate and you can ask them questions like this. They would go over your lease to see what you can do, they may make a phone call or send a letter on your behalf either to the other tenant or the landlord.

This would be a great thing to have for the future when you're over charged for car repairs, get a ticket and can't afford the points, or get sued.

You have as much right to enjoy your peace and quiet as any of your neighbors. Give a written complaint to your landlord and have him sign a copy saying he received a copy. Plus you could check into your city's bylaws on noise pollution and night time limits for playing loud music. You can call the police for nuisance and public disturbance. You can show them the complaint letter copies you gave the landlord. Plus the landlord can use those copies to get an eviction order if they persist with the disturbance.

If where you live there is a noise ordinance meaning no noise past a certain time,you can call the police and they will be fined,if they persist,they will be arrested.they will go to jail,peace and quiet for you.If your not sure about the noise ordinance,call the police anyway,your neighbors may be welll know to local law enforcement and the police would just love to come and shut them up.good luck

Consult your lease for any early out clauses.
. Consult local free lawyer agency.
Document tape any face to face harassment for your case. Your state city may have laws about your situation.

You should have a curfew by city ordinance.. If its after that time you should call the police.

I don't think there is a whole lot you can do. As long as the landlord will let it go and they pay their rent.

call the police whenever it happens and they will deal with it.. after I think two or three police visits I think something happens wiht them getting evicted or somthing
