A tv satallite company took money from my checking account causing an overdraft. I have never had anything to do with this company. I don't know why they would bill me, except for stealing.... I wasn't even really billed, they just took it from my checking account. This can't be legal can it? I never gave them my checking account number, or debit card number, and even if I did I don't think they can just take money without notifying me, right? When I called they company they confirmed I have never had an account with them, yet my bank assures me that this company took the money. What can I do to fix this? To make both these companies see their ignorance and theiving ways. I don't have enough money to pay a lawyer to try and figure it out....

Notify your bank that you did not authorize this debit from your account and also get a letter from this company that you contacted stating that you do not have an account so that you can get reimbursed by both the bank and the company.
The company should contact the bank and let them know it was mis-account information and your bank will investigate the debit amount. After everything you money and overdraft should go back into your bank account (this would be the bank's responsibility).
The next thing you want to do is change your account number to your checking account and contact all creditors: Equifax, Transunion, etc. and let notify them to put a "fraud alert" on you.

If the company says you never had an account with them, it's possible a third party has set up an account with your bank and is pretending to be this company, or that this company is just outright scamming you. Get as much information as you can from your bank about the company that took money from your checking account. If you buy anything online, you may have inadvertently checked a box signing up for a service that you didn't want (or even failed to uncheck a box that was automatically checked). I've never heard of this scam with a checking account, but it happens all the time to people using credit cards online. But get as much information as you can about the company from your bank and from them.
Your bank should have a policy regarding appeals. The specific policy should be in the papers they gave you when you signed up for the account. If you don't have those anymore, or if you've had the account for a long time (since they've probably changed), ask the bank for a copy of their policies, then file an appeal according to the policy. If the people at your local branch give you any trouble at all, bypass them. Get online and find the bank's corporate website and contact someone higher up than your local branch.
It's not gonna be quick and it's not gonna be easy. In the meantime, set up an account at a different bank and start using that account instead. When you've settled this, take your money out of your current bank and close the account, not only to get away from this bank, but to make sure whoever has your account number doesn't continue to use it.

I'd suggest having a meeting with the manager of the bank about this (a quick one to discuss the charges) and then they can call the company in your presence and attempt to get it straightened out. If that doesn't work, you can always pursue legal action and hire a lawyer to work on a case against the company who in effect stole from you.

You dont have to pay a lawyer, it is small calims court. Just call them and tell them that you are going to file a small claims on them and they will refund the money. If not it will cost you about 30 bux to file and you can ask for that money back from the judge. If what you say is true then you should have no trouble geting it.

You just call the company and get a refund and tell the bank that it was a mistake and you want them to remove the overdraft fee. If someone tells you they can't, talk to their manager. They can refund your overdraft fee.
It happened to me too. Don't sweat it.

idenity theft somebody probly got ahold of your acct# number you better dig a little deeper an check your credit report to see if any thing else is going on but did the satillite co give you your money back an did the bank credit your acct for over draft charges

If the company has your account info and you have an account with them they can draft on an account if there is a balance due.

no, it is not legal
it is either theft, or a mistake
talk to somebody at your bank, be calm, explain the situation, show them the documentation you have, if it is theft, you are probably not liable for the charge
if it is an error, it can be corrected
