I like living with my dad WAY better than my mom and my dad says that I can live with him only if its legal. My mom says I can move out if it is not documented. I wonder if I am old enough to move out by myself . My mom doesnt want to sign any papers. I think its because she will lose section 8 and food stamps and then actually have to work to survive. But is there anything that I can do to override her considering im 15. Maybe could I become emancipated. My mom is kinda nice and not abusive or anything I just like my dad's house better.

My dad doesnt pay all the child spport and my mom wouldnt have to pay, also we live in Ohio.

It depends on what state you live in. Each state has a different age in order for the child to have a choice. And even then, it means having to go before a judge if one parent disagrees. Becoming emancipated also means going before a judge. They will make you give your reasons for why you want to be free to be on your own. If the judge agrees, then you will be allowed that freedom. But remember that freedom also means paying your own way including rent and utilities.
As for section 8, yes she would what ever amount the state gives her for you. In some states, she would have to have children to even qualify for section 8.
Either route you decide to take, it would mean signing papers. Especially if your father pays child support. If you were living with him, your mom would have to pay support for you. She would most certainly have to get a job then.

Your Dad would have to sue for custody in the same court that granted your mother custody and get that custody order modified. At your age, your desires would carry some weight in most states; possibly enough weight to get the order changed.

The only other option is to wait until you're 18, when you can live anywhere you want to.

Emancipation won't necessarily get you what you are looking for. If you sought it and got it you'd legally be an adult and either or both of your parents could put you out on the street if they were so inclined.

Not all states recognize the principal of emancipation and even those that do will give a LOT of weight to your parents' desires in the matter. You'll need to be self-supporting already (not living with either parent) along with a number of other requirements so unless you have a full-time job that brings in enough to pay rent, utilities, and food the judge will never grant it.

You need to consider your mom, life isn't easy being a single mother, but speaking from experience my daughter at the age of 16, left home moved in with my parent and I will never get over the heartache, She is my only child, I never had help from any agency paying for anything. I worked two jobs to raise her and am still financially supporting her. No matter what she has chose to do I still love her with all my heart. Just give your mom a chance and know that what ever your decision is she loves you.

I think you can legally choose which parent you want to move in with after you reach the age of twelve. Emancipation is a long and semi difficult process, like you need a bank account with money in it, a job, a way to school and a place to live.

If the court who deems you old enough to decide that you are able to make up your mind then you can live with your dad. Don't emancipate you could end up on the streets.

Your dad will need to petition the court for change of custody. At 15, most courts will honor your request.

Your mother needs to get off welfare so she can pay child support when your dad assumes custody.

Nope, if she has custody you are stuck at the house you dont care for until your 18 sorry!
