Saying phallus is an expression, which is protected as speech under the First Amendment of the U.S. Constitution, and cannot be restricted by agents of public institutions, including public school teachers. However, there are a number of exceptions to this rule, which would allow school officials broad authority to regulate speech and expression. Whether you actually have a right to sue depends on a number of factors, including where and when this statement was made, and in what context. Presumably, absent political meaning, an obscene statement made during official curricular activity (i.e. during class) will be deemed speech that may be regulated and thus does not constitute a violation of your rights under the First Amendment.

There are LOTS of words in the dictionary that are not appropriate to say in school. It depends on what context you said the word. For example, "many aspects of ancient Egyptian art seem to contain images of a phallus" is ok, and you might be able to expect an appology. "Suck my phallus" however, is clearly NOT ok.
As for a detention, forget a law suit. If you were expelled or suspended, you might have one.... but not for a detention.

It depends on the published rules of conduct. what kind of place gives vocab words like that, anyway?
Here is a copy of your previous question.
"I put my hands on a co-workers neck (female) and she told my bosses it was sexual, am I going to jail?"
What kind of job is it that you have that you would get sent to detention?

No you can't sue, It is most likely the context with which you used the word that got you in trouble.
