The simple answer to your question is that the fence must be at least five feet -- and that is by State law (Cal Health & Safety Code § 115920 et seq.). There are also other requirements.

I would reccomend reading the applicable statute yourself before installing a pool (BTW, it qualifies as a "pool" it the water depth is more than 18 inches). I have placed a link to the statute below.

Kern County, California evidentially thinks that it needs to help you protect kids from getting in your 2-1/2 foot pool. How many times have you heard of kids drowning in a bathtub. Think of your 2-1/2 pool as a plastic, outdoor bathtub. Then think of the kids who could get into it. Then just get the fence built and make Kern County, California happy. It's a drag, but you have to keep the county happy.

I don't know what it needs to be in your county, but when we had a pool it had to be at least a 4-5 foot fence with a LOCKING gate on it.
It didn't matter the TYPE of fence. We had a wrought iron with spikes on top so kids couldn't climb on it. (they can a chan link)
