I'm 16 and i have a job and go to school. if i can find a home would it be easy for me to get emancipated? i am located in California

I do have a job and yes it is an abuse problem...where could i find an attorney do you think?

I live in Ohio now but became an emancipated minor in California when I was 16. I was in and out of trouble at home, but not with the law. Because of running away a lot I was asked by a family court judge what they should do with me, I told him that I wanted to be emancipated. I had no job & no home but with-out hesitation they granted my request and at the same time helped me with a place to live and a job search. This was some time ago but I would think it would be even easier now and you do seem responsible. Good luck. Note: An emancipated minor still can't do anything that you must be a legal adult to do, other than live on your own.

At the end of this post, I will give you a link to the section of the website for the California State Bar that discussions who to become emancipated. You must file a petition with the court and the following:

1. You are at least 14 years old;
2. You don't want to live with your parents. Your parents don't mind if you move out;
3. You can handle your own money;
4. You have a legal way to make money; and.
5. Emancipation would be good for you.

Once place you can start looking for an attorney is by calling the lawyer referral service for your local county bar association. There are attorneys that specialize in family law issues and representation of minors. Making your own money is one thing...proving you can support yourself is quite a different prospect.

No it is not easy at all, you will have to hire an attorney who will represent you in a law suit againt your parents.

you will have to show your job can support you ( you earn enough to pay rent, transportation, food and so on)

Next you will have to show you are still in school, since at 16 you would still be requried to be in school.

Next you will have to show a cause, a reason, serious emotional abuse, physical abuse or some reason other than not wanting to live with them.

It won't be easy but it is possible. You need to talk to a lawyer and be ready to spell out the reasons why. A judge will have to make the decision based on what is best for you.

Talk with an attorney, especially one who deals with family law. Many will give a free consultation, and can give you ideas on where to start.
If you try social services, they are not trying to help you, and your folks may wind up with legal charges against them.
