My first answer is : not if you get caught. Think Seat Belt. Also there may be an issue with air, etc.

I would think that it is illegal considering the fact that there are no seat belts in the trunk first of all. Second, if you were riding in the trunk of a car, and the car got rear ended, do you thiink you would be safe? Probably not a good idea to ride back there even if it's just a joke.

I have done it on a few occasions, but one in particular wasn't my choice in which case I probably could have let the authorities know, but then again I was so drunk and the guy's car was new and he didn't want me puking in it and hell I would have done the same thing to someone who was as wasted as I was. Then to top it all off I don't remember even riding in the trunk, until a buddy of mine brought it up later I sure as hell believed him though.
