i moved into this home last fall..along with my kids. Soon after moving in I noticed we were getting awefully sick, quite a bit, especially my 1 yr old. he was coughing so much the doctors put him on a nebulizer at home. I noticed that mold was growing in the bathroom, in the walls, all inside the fixtures. I have complained many of times to the landlord, he tells me he'll get something done about it but never gets back to me on it. Both the small children are coughing constantly now..the house has an aweful odor coming from the bathroom and basement. i dread colder weather, meaning I have to shut the windows up. Is there any kind of law that says he has to fix problems like that, seeings that in the lease we aren't suppose to attempt to change anything about the house..(he wants the old to stay). My kids sometimes cough so much, they gag themselves to puke. I've taken pictures of the bathroom to show how bad it is.

For the sake of your family you need to move immediately. Do you have rights? Absolutely, how-ever the time it takes to enforce these rights may pose a real danger to the health of your family. I suggest that you move today, I pray you have the funds to do so, if you don't I pray there is family or are friends that can help you. If not, even an emergency shelter is better, because this is an emergency.

Do what you can to move NOW and then sue the s.o.b. for actual damages & punitive damages. You need to get out fast. You are in danger. Document everything! Good luck!

first even though it would seem obvious that since your kids became sick when you moved into the house and their is mold in house that is the cause. The problem is you need specific evidence of the cause and effect, doctor's note etc

Best bet if you have the money in the yellow pages their are ton's of companies that do mold inspection if you have the money pay for a good and get a report on the type of mold you are dealing with next take the info to your kids doctor, do not tell the landlord of this or he will try and evict you

Once you have the info go get him for damages i bet even a pi lawyer if you do all the work might take the case

Call the local health department and ask them to inspect the house for mold. There are several types of mold that can be deadly or cause lifelong illnesses, especially to a small child.

If the landlord can not or will not repair the place to make it habitable, you might be able to break the lease. First things first will be to get the house declared unfit for human habitation. Call the health department and they'll tell you who to contact if they aren't the ones to do the inspection.

This sounds like a bad problem and yet you have stayed as well for whatever reasons. Your landlord is required by law to make the place liveable and it apparently is not. This place is hazardous to your health and especially the children. Especially the younger ones. Do not delay any longer!!!!! Contact your health department.

If he is not willing to fix the problem you should be able to break the lease...check with a lawyer first...most offer a consult ion for a reasonable price...but the safety of the kids needs to come first..get out if you do have pictures save them as proof take them to the county housing association in your area

Mold is a big issue today because so many people are negatively affected by it. No one would expect you to live anywhere where your kids are at health risk. It might be a good idea to check with a lawyer because every state has different ways of looking at things.

I am a certified mold inspector, contact your local health dept asap, and tell them your situation, this is an issue that needs to be corrected, most landlords do not want to address a mold problem, due to the expense.

Of course there are laws and you do have rights. If it is that bad though you should get your kids outta there, after all you are only renting, its not like you have to stay. It could cause lifelong problems not to mention cancers and other illnesses. But yes, look up the rental tribunal in your area. You also might want to talk to a lawyer.

Phone the Board of Health and have some inspectors come out and take a look.If this is a health problem then the Landlord is responsible.

Yes you have rights. I hope there is someone who answers this that knows who to contact I wish I did. I do know though for sure you have rights. At the very least you would have the right to break that lease so your kids arn't sick. Please attempt to do something soon I've heard cases where people have died from mold. I'm truely sorry I don't know who to contact but I assure you you have rights.
