Drop that 401K (cash out maybe) and put it into another account.
At the very least, stop contributing to it and just start a new one, its better than nothing.

Forge his signature with company and do a rollover to another institution. Other than that, take a loan against it and put the money somewhere in a separate account.

Get a good lawyer. How long you been married? Have you been married and working building up 401-K during entire marriage. Is he self supporting? These are the things to consider. But money could be considered property of marriage.

I'd get legal advice. Every state does offer free legal advice if you need it. Check with social services. If it was a long term marriage, 15 years or more, I don't think you can do much. -

But, if you weren't married for that long, she may not be entitled.

If you have children,. please keep it cordial. It may be worth giving in a little to keep the peace and maintain respect.

Sorry, if it was funded while you were married it is fare game.

My sisters ex-husband tried to play that game and he got caught. Court awarded her more than she would have gotten if he would have been upfront about it.

He worked for the Dept. of Energy and it paid pretty nicely I might add.
