I am on a month to month rental agreement and am ready to move out. I have given notice in excess of 30 days and will be moving out the 22 of the month. Am I able to prorate the final months rent since I will not be there the whole month?

After reviewing my rental agreement, I do not see any provision for this, so I guess I am out of luck?

Your landlord isn't required to allow it. S/he might be amenable to it, especially since you've given a lot of advance notice and s/he has more time to find a new tenant.

The best thing to do is talk with the manager. However in my 13 years of experience as a property manager, if the resident has given a 30/60 day (whatever the lease requires) notice and then extends it, a proration will be fine if they need to move during the month instead of the end. The main thing I needed was that they fullfilled their notice to vacate 1st and then let me know they need additional time. Make sure you talk to them though, it may cause problems for them as they may have preleased it to someone else. You need to let them know so they can handle that situation.

It largely depends on your contract. If it's not there, it's likely that it's not allowed. You can still try sweet-talking to your landlord though.
