When I filed chapter 7 bankruptcy, neither my lawyer or the bankruptcy trustee informed me that my debt to a university would still have to be paid. Is there anything I can do??

Your post isn't clear on why you believe the debt was not discharged. If it isn't a student loan, then exactly what type of debt is it? Yes, it is true that student loans are almost impossible to discharge in a Chapter 7 bankruptcy. However, the dischargeability if any particular debt is determined by the type of DEBT, not the type of CREDITOR. If the university debt is not a student loan, then I would go back to your bankruptcy attorney to find out exactly what section in the Bankruptcy Code applies to allow this debt to survive the discharge.

There is absolutely nothing you can do, other than to start paying it off. School debt is excluded from bankruptcy. They won't let you get out of it. You were informed, but you just failed to read the fine print when you signed on the dotted line. You can't get out of a student loan at all.

You cannot discharge student loans in a bankruptcy filing - not Chapter 7.

it should've been written on the paperwork you filled out when filing for bankruptcy. from what i remember.. school loans and any money owed to the goverment can not be included in a bankruptcy.

Miss Cassie you are stuck with them.

Federal Law states that student loans can not be writen off in bankruptcy.

Surely now that all of your other bills have been written off you can afford the small monthly payments of student loans.

that is federal law, you should have asked. student loans, alimony and child support can never be bankrupted. there is nothing you can do. set up a payment plan.
