Must leave an abusive husband and want to take my child out of state of TN and go to Grandparents home.

I live here in TN and when you are living under the conditions that you are living in YOU ARE NOT BREAKING ANY LAWS, wanting to move on and Protecting your children. Just get to where you are going then contact spouse by cell phone or pay phone letting them know that you can not live that way and you wish to be where you are, It's that simple. You do not need a consent to do anything pertaining to the kids Hell you are PROTECTING THEM. DO WHAT YOU NEED TO DO, Notify Grandparents as to what you are about to do, If they are in your corner SAY NOTHING TO THE ABUSIVE SPOUSE, And just GO, WISH YOU/KIDS WELL, AND PLEASE BE SAFE.

I'm not sure, but what you can do is file for temporary custody. That gives you legal custody of the kids until an actual divorce hearing can be done to determine custody of the child. In the state of Texas unless you have one filed the spouse can take the children where ever and there nothing that can be done. However, I am not sure about TN. I would think a temporary custody would insure that even if you do leave he can't take them from you until the court has heard your case.

You need to contact an attorney. They would know more than. You may be able to do a search for TN laws.

get a lawyer --- file abuse charges(get restraining order) against spouse and take your child with you to the grandparents...
