When a soldier surrenders or is captured he is considered a prisoner of war. The international law of war would hold that he is a POW and is entitled to be treated accordingly. After prisioners were held to be not prisoners or war but terrorist detainees by the US perhaps the rules don't apply to Arab provisional military groups like Hezbollah.

a POW is a prisoner of WAR. this means war should be declared BEFORE the soldier was taken. anyway, the militias are not armies and Therefore they don't answer to any government, and they don't recognize the 4th Geneva convention (they orchestrate attack that are deliberately aimed at civilians)

A POW: and the radicals who might abuse that soldier are breking the long-standing rules of the Geneva Convention. If they do, they stand to be brought up on charges of war-crimes and crimes against humanity.
