Statutory rape is a strict liability offense. That means that if one partner is over 18, and one is under 16 ( I believe that's the standard age, but you would have to check your state rules) then they are considered a criminal. It doesn't matter if the older person didn't know the other was under 16, and it doesn't matter who started it.
You may like the person your friend is with, but there are many reasons older men go for extremely young girls...and none of those reasons are nice. Your friend should be with someone her own age...and if you really love your friend, you will encourage her to tell her parents...or tell them yourself.

I was once this situation. I was 15 and he was 18 and my parents found out and pressed charges. Because I was under the age of 16 the charges were more severe. It doesn't matter to the law if they are in love and if its stated that it was her fault. It takes 2 to sleep together. The only way he will get into trouble is if they have sex. My ex was facing 30 years but I convinced my parents to lessen the charges and it was that he was under probation til I was 18 and we were only allowed to be together under adult supervision and some other small bullshit. But since he is older it could be worse. I don't know. It depends on her age. Just becareful and I hope some of this info has helped.

If she is underage, she cannot legally give consent. It doesn't matter what she says. He is guilty of statutory rape and can go to jail for a long time. Why would a man his age want to have sex with a child? What he is doing has serious consequences.

It doesn't matter "who started it." It's still illegal for an adult to have any sort of sexual relationship with a minor. Depending on your state's statutes, he will probably be charged with statutory rape. How old is your friend?

If she's under 18, her parents can have him prosecuted in many states. I'm not sure what the legal majority is in MS.
