I don't know if they should get a ticket but the trend is getting carried away. People are leaving stuffed animals for grown men who died in a bar fight for Pete's sake. Some of the places where people have died are dangerous places to be putting up memorials. That's what the cemeteries are for. I have a friend that died and his family cremated his body and I have gone to the site where he died because there was no place to pay respect so I know where your Mom is coming from. I feel for her.

Lot of times people put up crosses and a lot of stuff, come back a few times and then forget it, Flowers ribbons, stuffed animals , often laying in a dirty soggy heap. That's not respectful to your loved one, but I think the ticket was a bit over the line.
For many years, we have made trips to San Francisco, through the farm country of Northern California. About 12 years ago, we saw a good sized white cross, about 10 feet from the road beside a rice paddy. There was a bow on it and silk flowers at the base. Over the years, we have always watched for it and it has always looked as nice as the first time we saw it. My husband thinks its for an auto accident as that stretch of road is prone to them, but I prefer to think its for some beloved farm dog.
Well, we were going to stop at a farmhouse and ask one day, and almost at the same time, we said , "No, lets not"! It's a testament to someones Love and devotion and we'll keep it at that and always watch for the cross.
I don't know why I told you this story, but I hope that you will be blessed and I'm sorry for your loss.

States have the statutory authority to regulate the health, safety, morality, and welfare of their citizens (traditional police powers). If the legislature in your mother's state has determined that crosses at an accident site might create a problem then they can write a law to essentially ban such displays (time, place, manner restrictions on speech). A ticket would be the most likely punitive action taken by the state in such a situation. So, the short answer is--if it's against the law in your state then she should get a ticket for it (whether or not it's a good law is another question).

It depends on where that place was. If you're endangering peoples lives to put a cross some place, you should get two tickets, no three. If it's a litter related offense, the cop should let it go. As long as it's reasonable and not some six foot piece of christian architecture looming over the highway.

Yes.
Not placing it correctly can be considered a road hazard or public endangerment. It can also be considered littering in some places.
Imagine if a vehicle pulling over to the side of the road were to hit the cross and knock it in to the air and now it becomes a projectile that hits another car or worse, causes an injury.
Please find another way.

I would think not. Not sure if where you live makes a difference with city/police rules. But here where I live, in Canada, people do that sort of thing all the time. Although, it's mostly flowers. As for it being a cross, maybe it would depend on the size.

Ive seen crosses on the highway for the last ten years .I even keep a few up near my house . cut the grass ,repaint , so on. I dont even know one of the persons. Ive never heard of it being illegal.
