Legally they could...but I feel that roadside meorials should be allowed and that to punish someone trying to respect that person's memory should be made illegal.

These roadside memorials can be responsible for more accidents. People slow down to read the memorials, and this causes traffic problems, and people can crash as a result. Also, many of these memorials are placed in such a position that they obstruct the view, again leading to accidents.
Finally, these roadside memorials can increase the cost for upkeep of the right-of-way. They get in the way of the mowing crews.
Don't be surprised when the memorial gets taken down and thrown away.

Should and is it legitimate are two different questions.
Should, probably no.
Legally, quite possibly yes. Cities and states control what can go by the roadside in an effort to minimize distractions because distractions can cause accidents.
The prosecutor should dismiss the action with court costs to your mom with her promise she won't do it again.

I do not think people should get a ticket. But I do not like the crosses on the side of road. I feel once you die the soul has gone. But if it brings your Mother peace She should be able to do it.

I wouldn't think so. In my hometown, people do that all the time, and once they flowers or cross starts to look worn, they replace it, and the police have never bothered those people. Of course, like anything else, it would change depending on where you are at.

Of course not! Well unless it was like on the highway and obstructing traffic, but if its not obstructing anything or anyone from their normal day-to-day activities, I don’t see why she should.
